Hear2There Technologies, LLC, together with its subsidiaries and affiliates (collectively "Hear2There," “H2T,” “we,” “us,” or “our”) operates the Hear2There mobile application and website (available at www.H2T.com).
We are committed to protecting user privacy and complying with applicable United States data protection laws. We have created this Privacy Policy to explain what information our mobile application and website collects, how we use that information, and with whom we share information. This Privacy Policy does not address the privacy practices of any third parties who may also use our mobile application.
For purposes of this Privacy Policy, the term "Personal Information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual.
SUMMARY
We collect certain limited Personal Information from individualswho use the Hear2There mobile application ("End Users") and from those public venues, property owners, and their personnel (collectively "Property Owners") who support and make the Hear2There mobile applicable features available for End Users.
For End Users, the Personal Information we collect from the Hear2There mobile application consists primarily of geolocation data. No other identifying information, such as name, email address, or mailing address is required to use the services.
For Property Owners who use the administrative features of the Hear2There mobile application, we collect more detailed Personal Information to ensure the safe, secure, and efficient operation of the services.
Finally, for End Users and Property Owners who access our website, we may collect certain additional Personal Information (primarily cookies and similar tracking technologies) as described in the "Use of Cookies" section below.
We do not sell or rent any Personal Information to third parties.
Hear2There seeks to limit the amount of Personal Information End Users must provide to use and enjoy our services and features.
When using the Hear2There mobile application, your device's geolocation is read by the app locally on your device and is used to match your position against the Hear2There Points of Interest that are included in the app. Your precise location is not transmitted to Hear2There servers, and no personally identifiable information about you is transmitted off your device. The app does not require you to create an account, provide your name, email address, or any other identifying information in order to use the End User features.
Except for the limited use of geolocation data, we currently do not collect any of the following Personal Information from End Users when using Hear2There mobile application:

Hear2There uses cookies and similar tracking technologies when you access or use our website (available at www.H2T.com). Cookies are small text files that a website uses to recognize repeat visitors and maintain session information. We use session cookies (which expire once you close your browser), persistent cookies (which remain on your device until you delete them), and other technologies such as web beacons and pixels to collect data and enhance your experience with our website. We use these technologies for various purposes, including to personalize your experience, analyze which portions of our website are visited and used most frequently, measure and optimize the overall effectiveness of our website, maintain security, and remember your preferences. You can control cookie deployment by adjusting your browser settings to disable or restrict cookies. However, if you disable cookies, you may still access our website but certain features and functionality may be limited or unavailable.
The Hear2There mobile application uses Bluetooth Low Energy (BLE) beacons, Ultra-Wideband (UWB) tags, and device GPS to detect nearby Points of Interest, transit stops, and to provide real-time audio navigation guidance.
Precise location stays on your device. The Hear2There mobile application reads your device's precise geolocation (latitude and longitude) locally on the device in order to determine which Points of Interest are near you and to provide audio guidance. Your precise location is not transmitted to Hear2There servers, is not shared with third parties, and is not stored anywhere off your device. Similarly, no personally identifiable information (such as your name, email, phone number, device identifier, or advertising ID) is transmitted off your device in connection with the End User features.
Foreground location. While the app is open and in use, the device's operating system provides your geolocation to the app so it can: (i) determine which nearby Points of Interest are in range, (ii) provide directional audio guidance to a selected destination, (iii) display your position on a map, and (iv) associate you with the appropriate transit stop or venue beacon for contextual audio announcements. All of this processing happens on your device. Location data used for these features is not sent off the device.
Background location. With your explicit consent (granted by selecting “Always Allow” when prompted by the operating system), the app uses location in the background for the sole purpose of geofencing. Geofencing means the device's operating system notifies the app when you enter or exit a predefined geographic area around a Hear2There-accessible Point of Interest, transit stop, or venue beacon. When this happens, the app may display a local notification on your device so you know the Point of Interest is available. No location information is transmitted off your device as part of this background processing. The geofence check and the notification are generated locally on the device by the app and the operating system. If you do not grant background location permission, the app will still function, but you will not receive geofence-triggered notifications when the app is backgrounded.
Bluetooth scanning. The app scans for nearby BLE beacons and UWB tags that are part of the Hear2There network. Bluetooth scanning is used solely for proximity detection. We do not use Bluetooth to identify other users or to track you across unrelated venues.
How location is used. Your geolocation is used on your device solely to deliver the features described above. Because location is processed locally and never transmitted off your device, we do not use your location data for advertising, we do not sell or rent it to third parties, we do not share it with data brokers, and we do not store it on our servers.
Your control. You can revoke foreground or background location permission at any time through your device's operating system settings. Revoking location permission may disable some or all features of the app.
We do not collect any analytics, crash reports, or usage data from End Users of the Hear2There mobile application that could be linked to an identified or identifiable individual.
For Property Owners who access or use the administrative features of the Hear2There mobile application or website, we collect:
This information is used solely for the following purposes: system administration and maintenance; security and fraud prevention; product and service improvement and development; customer support; and compliance with applicable laws and legal obligations. We do not sell or share this information with third parties for their marketing purposes.
We implement and maintain reasonable administrative, technical, and physical security measures designed to protect the Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. These measures include encryption of data in transit and at rest, access controls, and regular security assessments. Please understand, however, that no security system is impenetrable. While we strive to protect your information, we cannot guarantee absolute security of our databases or the databases of the third parties with which we may share information, nor can we guarantee that the information you supply will not be intercepted while being transmitted over the Internet. In particular, e-mail sent to us may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail. We recommend that you do not send sensitive Personal Information (such as social security numbers, financial account information, or passwords) to us via unencrypted e-mail. In the event of a data breach that affects your Personal Information, we will notify you in accordance with applicable law.

We will respond to your request within 45 days or as otherwise required by applicable law, though we may extend this period by an additional 45 days when reasonably necessary, in which case we will notify you of the extension and the reason for it.
California residents have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including the right to know what Personal Information is collected, sold, or disclosed; the right to opt-out of sales and sharing for cross-context behavioral advertising (though we do not sell or share personal information for such purposes); the right to limit use of sensitive personal information; and the right to correct inaccurate information.
We will not discriminate against you for exercising any of these rights.
Our services are not directed to children under 13 years of age (or under 16 in California). We do not knowingly collect Personal Information from children under 13 (or under 16 in California without parental consent). If we learn we have collected information from a child under the applicable age threshold, we will delete it promptly, typically within 30 days of discovery. This Privacy Policy is effective as of the date stated at the beginning of this Privacy Policy. We may change this Privacy Policy from time to time. Any such changes will be posted on our website and the Hear2There mobile application. We will notify you of any material changes to this Privacy Policy by posting a notice on our website and mobile application at least 30 days before the changes take effect. By continuing to access our website or the Hear2There mobile application after the effective date of such changes, you are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, our use of Personal Information collected prior to any changes will be governed by the Privacy Policy in effect at the time we collected such information, unless you affirmatively consent to the application of the new Privacy Policy to previously collected information. If you do not want to accept material changes to the Privacy Policy, you may object to such changes by contacting us at info@H2T.com within 30 days of the notice of changes. If you do not wish to continue using our services under the revised Privacy Policy, you may terminate, close, and discontinue use of our website or the Hear2There mobile application, and we will handle your previously collected Personal Information in accordance with the Privacy Policy under which it was collected. You may close your account and request deletion of your Personal Information by contacting us at info@H2T.com. We will respond to your request within 45 days as required by applicable privacy laws and will delete your Personal Information in accordance with our data retention policies and legal obligations.
